Short deliveries must not be accepted, and all the goods must be given to the driver of the delivery
vehicle for return to Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) ltd.
Pricing Policy
Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd reserves the right to change
the pricing of goods from time to time without prior notice to the client. Pricing must be confirmed via an
official quotation prior to confirming an order.
Payment and Delivery
Subject to availability and receipt of payment, requests will be processed within one (1) working day and
delivery Within 10 working days. Ownership in all goods sold and delivered shall remain the property of
Primafacie Investment Solution (pty) ltd, Prima Office Automation (pty) ltd until the full purchase price has
been paid.
Any delivery note (copy or original) signed by the client and/or its authorised representative and/or its
nominated agent and held by Prima Office Automation (pty) ltd, shall be prima facie proof that delivery
was made to the client.
Trade Safe is an independently reviewed escrow and paymaster services provider that safeguards the
buyer’s funds in trust in a transaction involving two or more parties. The funds are only released to the
seller, and other approved beneficiaries once the buyer receives the goods or services in the agreed
condition.
Product Information
The product pictures and specifications may be updated from time to time and change without prior
notice.
Order Cancellation
The provision of goods and services by Primafacie Investment Solution (pty) ltd t/a, Prima Office
Automation (pty) ltd is subject to availability.
In cases of unavailability, Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) ltd
will refund the client in full within 10 (ten) days of the confirmation of order.
Any cancellation of an order by the client must be conducted before the client’s order has been
dispatched and will attract a 15% handling and restocking fee on the value of the order cancelled for
administration purposes.
Return Policy
Our Standard Returns Policy
We want you to be happy with your purchase. If you are not completely satisfied, you can return the
product to us and we will either repair/replace it, or credit your account, subject to the below terms.
1: Unwanted products
You can return an unwanted product to us at no charge, provided:
it is undamaged and unused, with the original labels and stickers still attached;
save in relation to Unboxed Deals, reconditioned products and used products, it is in
the original packaging, which must be undamaged and in its original condition with all
seals still intact (if applicable).
it is not missing any accessories or parts;
You log a return within 30 days of delivery to you or collection by you of the unwanted
product. After 30 days, you can only return a product if it is defective; and
it is not one of the products listed below.
Changed your mind?
Where you have changed your mind and would like a credit for a product, you can return it – provided
the product is not:
a product which has been personalised for you or made to your specifications; or
a flat pack furniture product that has been assembled after delivery.
We will collect the product from you at no charge. Once we have inspected the product and validated
your return, we will credit your account with the purchase price of the product within 10 days of the return
(or refund you if that is your preference).
Not what you ordered?
If we accidentally deliver the wrong product to you, or if the product is not as described on the Website,
please notify us and we will collect the product from you at no charge. If the product is missing any
accessories or parts, inspected the product and validated your return, we will at your choice deliver the
correct product to you as soon as possible (if the correct product is available); or credit your account with
the purchase price of the product within 10 days of the return (or refund you if that is your preference).
2: Products damaged on delivery
Should a product be damaged or missing any parts or accessories at the time of delivery /
collection, please notify us within 7 days of such delivery / collection by logging a return on email.
We will arrange to collect the product from you at no charge. Once we have inspected the product and
validated your return, we will at your choice repair / replace the product as soon as possible (if such repair
is possible/ we have the same product in stock to use as a replacement) or credit your account with the
purchase price of the product (or refund you if that is your preference).
3: Defective products
We do our best to ensure that the products we deliver to you are of a high quality, and in good working
order and without defects.
What is a defect? A defect is a material imperfection in the manufacture of a product or any characteristic
of a product, which makes the product less acceptable than one would reasonably be entitled to expect in
the circumstances. Please refer to our FAQs for some examples.
The following will NOT be regarded as defects and will not entitle you to a return under this section 3:
faults resulting from normal wear and tear;
damage arising from negligence, user abuse or incorrect usage of the product;
damage arising from electrical surges or sea air corrosion;
damage arising from a failure to adequately care for the product;
damage arising from unauthorized alterations to the product;
in relation to Unboxed Deals or used products, signs of handling and/or repackaging.
Standard Warranty
If you have received a product which turns out to be defective or otherwise of poor quality (save for
manufacturer warranty products which are discussed below), please notify us as soon as reasonably
possible after you become aware of the defect or poor quality, but in any event within 6 months after
delivery / collection of the product (except in the case of an extended supplier warranty, which is set out
below).
You can do so by sending an email to sales@primaoffice.co.za, and we will arrange to collect the
product from you at no charge. Once we have inspected the product and validated your return, we will at
your choice repair / replace the product (if such repair is possible / we have the same product in stock to
use as a replacement) or credit your account with the purchase price of the product (or refund you if that
is your preference). If the repair / replacement takes longer than 21 days, we will get in touch with you to
see if you would rather receive a credit / refund.
Where there is no extended supplier warranty period, unfortunately we cannot facilitate returns that fall
outside of the 6 month period.
Where you request a repair / replacement of an Unboxed Deal, reconditioned product or used product
and a repair is not possible, we will see if we have a replacement Unboxed Deal, reconditioned product or
used product in stock (which is the same product, of the same nature and type, as the one sold), but if we
do not, we will credit / refund you. A product in perfect condition (that is not an Unboxed Deal,
reconditioned product or used product) is not the same product as an Unboxed Deal, reconditioned
product or used product. This is why Unboxed Deals, reconditioned products and used products are
discounted, compared to products in perfect condition.
Extended Supplier Warranty
A product may have a supplier warranty that extends beyond the 6 month Standard Warranty. If such a
product turns out to be defective more than 6 months after delivery / collection (save for manufacturer
warranty products which are discussed below), please notify us as soon as reasonably possible after you
become aware of the defect, but in any event within the extended supplier warranty period after delivery /
collection of the product.
You can do so by logging a return on the Website, and we will facilitate your return of the product to the
supplier at no charge. Unfortunately we cannot facilitate returns that fall outside of the extended supplier
warranty period.
Please note that any extended supplier warranty is subject to whatever terms and conditions the supplier
or manufacturer may impose. These are usually stated in a brochure or leaflet inside or on the product
packaging. It is your responsibility to make yourself aware of any such terms and conditions.
It is also important to note that the remedy offered to you is at the supplier or manufacturer’s discretion
what remedy it can offer you. Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty)ltd
is under no obligation to provide you with a credit, repair / replacement, as your remedy lies with the
supplier or manufacturer. However, since we want your experience to be as good as possible, if the
supplier or manufacturer has offered you a repair / replacement within the applicable extended supplier
warranty and it takes longer than 21 days, we will get in touch with you to see if you would rather receive
a credit / refund directly from us.
Manufacturer Warranty
A manufacturer warranty product is a product for which the relevant supplier or manufacturer chooses to
manage defective returns themselves, directly with the customer, and not through Prima Office (pty) ltd,.
If a manufacturer warranty product turns out to be defective or otherwise of poor quality, please contact
us directly via the contact details provided on our website.
7: Charges and refunds
If you return a defective product to us, but you fail to return all of the accessories and parts that
were sold with that product, we are entitled to (subject to applicable law) refuse the return, or only
to replace the item that you did return; or to estimate the value of the missing accessories and
parts and to credit or refund you in respect of the returned item only.
If you return a product that does not comply with this Policy, you may be liable to reimburse Primafacie
Investment Solution (pty) ltd t/a, Prima Office Automation (pty) for the cost of collecting the product from
you and the cost of having the product returned to you.
Please note that we only refund to the payment method that you originally used – i.e. payment by
credit card will be refunded to the same credit card, payment by Instant EFT or COD (cash on delivery)
will be refunded to your nominated bank account.
If you used the Ned bank Personal Loan payment method, your refund will be processed as follows:
If, at any time, items are returned (and such return is approved by Primafacie Investment Solution (pty) ltd
t/a, Prima Office Automation (pty) in accordance with the this Returns policy or cancelled before delivery
in accordance with customer terms and conditions, the value of the validated refund or cancelled item (as
the case may be) will be credited to your loan account or repaid to you by Ned bank.
However, if you, within 45 days of that order being placed, process a return of your entire order (and such
return is approved by Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) in
accordance with the Return Policy or you cancel your entire order before delivery, and there is no delivery
charge on the order, then Ned bank will refund you with any fees and interest due on the loan and cancel
the loan accordingly.
Client Privacy Policy
Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) ltd shall take all reasonable and
responsible steps to protect all personal information of its users and clients. For this clause, “personal
information” is defined as in the Promotion of Access to Information Act 2 of 2000 (PAIA). For more
information about the PAIA, please visit http://www.doj.gov.za/paia/paia.htm.
The client confirms that all information given is accurate and complete, and the client agrees to update
any supplied information when necessary in order to ensure the accuracy of the above information failing
which Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd will not be liable for
inaccuracies.
Legal Proceedings
These terms and conditions shall be governed and construed under and in accordance with the laws of
the Republic of South Africa. Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd
shall, at its option and notwithstanding that the amount of its claim or the nature of the relief sought
exceeds the jurisdiction of the Magistrate’s Johannesburg, be entitled to institute action out of such court.
A certificate issued and signed by any member of Primafacie Investment Solution(pty)ltd t/a, Prima Office
Automation (pty) ltd, whose authority need not be proved, in respect of any indebtedness of the client to
Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd or in respect of any other
fact, including but without limiting the generality of the a foregoing, the fact that such goods were sold and
delivered, shall be prima facie proof of the client’s indebtedness to Primafacie Investment Solution(pty)ltd
t/a, Prima Office Automation (pty) ltd and prima facie proof of delivery of the goods in terms of this
contract.
Any document will be deemed duly received by the client within:
three (3) working days of pre–paid registered mail to any of the client’s business or postal
addresses or the domicile address of the client.
24 (twenty–four) hours of being emailed to any of the client’s email addresses on being delivered
by hand to the client; or
48 (forty–eight) hours if sent by overnight courier.
The client agrees that neither Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation
(pty) ltd nor any of its employees will be liable for any negligent or innocent misrepresentations
made to the client, nor shall the client be entitled to release from these terms and conditions on
those grounds.
Arbitration
Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd may refer any dispute arising
from or in connection with this contract to arbitration which arbitration award shall be final and binding on
the client and Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation (pty) ltd. The arbitrator
will be a person agreed upon by the parties or failing agreement, appointed by the Arbitration Foundation
of Southern Africa, who shall then finally resolve the dispute or issue in accordance with the Rules of the
Arbitration Foundation of SA. The arbitration must be held at the place and in accordance with whatever
procedures, the arbitrator considers appropriate.
Indemnity
The customer indemnifies and holds Primafacie Investment Solution(pty)ltd t/a, Prima Office Automation
(pty) ltd (including its employees, subcontractors or subsidiaries) harmless against all claims of
whatsoever nature that may be brought or threatened against Primafacie Investment Solution(pty)ltd t/a,
Primafacie Investment Solution (pty) ltd t/a, by any third party arising from or in connection with any
defect, latent or otherwise in any goods supplied and/or services rendered by Primafacie Investment
Solution(pty)ltd t/a, Prima Office Automation (pty) ltd.
Country of Domicile
This website and all other online documentation and functionality is governed by the laws of South Africa
and Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) ltd chooses as its
domicilium citandi et executandi for all purposes under this agreement, whether in respect of court
process, notice, or other documents or communication of whatsoever nature the following address: 893
Indwa street, Naledi ext2, Johannesburg 1861.
Variation
Primafacie Investment Solution (pty) ltd t/a, Prima Office Automation (pty) ltd may, in its sole discretion,
change this agreement or any part thereof at any time without notice.
